If you are an EU customer, you could try to use the European Small Claims Procedure for claims below 2000€ or the European Order for Payment Procedure for claims above 2000€ instead of the UK Small Claims procedure. These are standardized EU procedures that are implemented in national law by the member states. As a consumer, you file the application forms with a court in your own country, not in the defendant's country. The defendant has to reject the claims within 30 days or otherwise you get a title that is enforceable in the defendants country.
You can find the forms in all EU languages on the European e-Justice Portal:
European Small Claims Procedure (below 2000€)
https://e-justice.europa.eu/content_small_claims_forms-177-en.do
European Payment Order (above 2000€)
https://e-justice.europa.eu/content_european_payment_order_forms-156-en.do
To change the language of the PDF forms, use the dropdown on the top right corner of the website.

Hi, just started (via lawyer) the european claim today. The claim went out today to the court. My lawyer said its all a winner. No way Alpha can defend it. I'll keep you updated

Hi ;)
I'm in the same situation as you.
Yesterday, I just send my european claim by mail to the County Court Money Claims Centre (CCMCC)
Let me know the status of your claim.
Good Fight

hello,
I'm just trying to fill out the application and have my limits. I am familiar with looking for support or a lawyer of this method. I'm from Cologne, Germany.
Overall, I ordered 2000 MHS, is charged 30% of the final payment I have not done.
For assistance leading to a refund I am willing to pay 10% of the refund commission.

Hi,
if you successfully filed your application for a European order for payment, how did you pay the court fees?
I've sent my application to ccmcce-filing@hmcts.gsi.gov.uk and got the following reply:
Dear Sir
Thankyou for your e-mail.
Unfortunately the Court could not process this because there was no claim number and no fee.
Please forward to the your document with claim number and fee of £50.00 for process.
Kind Regards
CCMCC
According to https://www.gov.uk/make-court-claim-for-money/court-fees, it seems like I have to "pay with a postal order or cheque (payable to ‘HM Courts and Tribunals Service’)". Is that correct?
Cheers

Anyone who had any luck here?
I ordered 2 Viper 250 mh/s and I'm from the Netherlands, was just wonder whether anyone had any success on getting their money back.
-
I'm not based in the UK so I can't say to it.
-
Question: I got 40% back. Can I still sue or claim the outstanding 60%?
If yes, then I'll go for it via the EU claims procedure.
Thanks for your assistance.
Best regards,
Jeff

If you didn't say something along the lines of "This is a full and final settlement" then you should be OK to sue.

Did anyone succeed with sueing Alpha through a claim filed in the EU?
