Judgements / Re: Form N349 - Successful
« on: August 26, 2015, 06:05:55 pm »
Has anyone pursued Alpha via the N316 route to find out their assets? If so how much do they actually have?

Also say they switched bank recently within the UK. Would they be obligated to disclose these details to say... Companies house?

I do wonder are they simply able to just move money around indefinitely to dodge third party debt orders. Even worse move it abroad (surely illegal!).

I have just received a reply from Lloyd's bank stating that no cleared credit balances were held in the judgement debtors name.

Looks like they are moving funds around to dodge this, or are broke. If they are moving money around is this even legal?

Great job and congrats!

Are you sure you need to cc Alpha when filing the n349? Isn't the idea that they are unaware until the interim order is filed so they don't have the opportunity to bury funds?

Sanj you need a county court judgement (CCJ) against alpha; then you can enforce this using an n349 (third party debt order).

Alpha have basically ignored all county court judgements against them so you need to try and "freeze" their assets to get your money.

If you paid by debit card some people have had joy by trying to charge it back, although expect a struggle to succeed here as strictly speaking you should have claimed a while ago!

Judgements / Alpha's accounts

Hi all

Has anyone managed to gain sight of Alpha's accounts? Do they still have cash? I am thinking of getting a third party debt order but this is a waste of time if the basket is empty.

No payment yet Bluepepsi. Although they have a few days left... Was always under the impression this case was only the first battle. Possession really is 9/10ths of the law!

I am happy to report another win today in court in Manchester. Good luck to all others with a date coming up. One note to people submitting evidence based on the DSRs. Be absolutely sure to include information stating your order has been cancelled. Be sure things are not still hanging in the air over it. In any event the fact they have missed q3 shipping is a slam dunk.

Great job. My hearing with them is imminent within the next fortnight. Am open to clubbing together with other people to try and enforce judgement when it comes. I am also based semi-locally if that helps (not a lawyer though). PM me

Hi guys I think this one from from 18/11/2014 is missing.

There is quite a key quote here:

"We would also like to take this opportunity to state unlike other companies we are actually giving refunds to customers as a goodwill gesture despite our refund period being passed. "

                     Greetings Miners!

First of all we must say we do sincerely apologise for the delay in releasing this update, the engineers at the foundry were working on the test solution in an iterative way with our original designers because the test vectors supplied by the designers did not work immediately, this took longer than expected to correct however we have worked diligently to do so.

We can now confirm to you our miners will be capable of being overclocked thus increasing their performance. Also here are some images of the final enclosure and boards:

Whilst the chips have been very costly and complex to produce they have been worth it as it seems as of now are the most efficient on the market working better than expected at 1.5 Mh per chip. As they have turned out so well they are of course going to be very desirable on their own as such we plan sell them in wholesale bulk; with customers benefiting from this via the profit sharing scheme of which we are happy so many of you are on board with.

We would also like to take this opportunity to state unlike other companies we are actually giving refunds to customers as a goodwill gesture despite our refund period being passed. We also feel the increased hashrate (10x the original hashrate),  and being a part of a large profit sharing scheme makes up for shipping later than anticipated. On that note we are glad to be able to finally announce shipping will be commencing soon however we are still working further to make the devices more efficient. We are very excited about moving forward with you all into the future of this industry so look forward to what will likely be the final batch 1 update very soon.

Best Regards,

Mohammed Akram
