Judgements / Re: Form N349 - Successful

Yes you are right.. only CC alpha AFTER the judge has granted the interim 3rd party debt order.

N349 -> judge grants interim 3rd party debt order -> Contact Alpha -> final hearing -> judge grants final 3rd party debt order

great job fightalpha. question: why and when must the witness statement be sent to the court? is n349 not enough?

You need to force them with a form N349 if they used BitPay.
Can you please explain in a bit more detail? If someone paid via BitPay, BitPay has transferred the money to the bank account of alpha, and you must know the details of the bank account to file N349. An then it only makes sense to file when there is still money on it, which you don’t know unless you obtained an order of information. If there is no money on the account you paid the 100 Pounds fee for nothing.

I'm in!

I am one of the claimants fightalpha mentioned above who won their case last week.

I started my claim in November via MCOL -> UK correspondence address -> no mediation -> non UK citizen defence from alpha-t -> transferred to Manchester County Court -> alpha-t did not send documents required for case being dealt on papers -> hearing -> WIN

I guess all of you who started a claim will win, as long as you comply with court directions.

If the defence of alpha-t is nonsense or not a real defence you may consider a summary judgment like the admin described in the step by step instructions, so you don’t waste time and money for the hearing.
