@Alpha-Oops: Great! I hope you win default judgement. If Alpha files a defense, PM me and I'll let you know if I think you can request a summary judgement against it.

@Sanj: Yes you should file a claim today. With any luck you'll win by default. The court is probably seeing so many of these claims I'm sure they're gonna get sick of them.

I have got a judgement by default as Alpha did not respond. But, I was advised to go to high court with a higher amount of money Alpha owes me. Do you anybody has already gone to the high court in London?

In waiting for the response from Alpha to my mediation letter, I consider to fight against AT in court with the following attacks:
1. As I paid in full, I am mostly concerned about the refund of the final payment (70%). In the Jan's terms and conditions, there is no place mentioning the refund of the final payment and also, in the following updates, I did not hear it.  Their response to my request is: as we do not mention it in the contract, there is no refund for the final payment. Their reason is very weak and liable to be attacked.
2. The timing of notifying customers to pay the final payment is at the start of assembly and shipment. But, actually, they knew by the time that they could not start assembly  process, and thus, the announcement of collecting the final payment  is to deceive our customers. This is a very serious problem of deceptive marketing.
3. They got our final payment and then told us that the product delivery was postponed to Sept, two months later. In the contract, they were not authorized to change delivery date and also broke the contract terms of collecting final payment three months ahead of the delivery.
4. The terms and conditions of Jan's version do not regard us as business and individual customers. They put these additional terms in later versions of the terms and conditions, which cannot apply to our earlier customers.

We can find more on their violation of the terms and conditions in their emails and July announcements (updates). The more they said, the more easily they will be attacked. Let us discuss and provide more to make them loose their defense in courts.

Thank you for supporting this piece of argument against them and for providing Fiaz's post on this issue. Hopefully, we can get more from their explanation to build a strong case. I will share details with all of us in another post or thread. It is true that they deceived us to pay the final payment despite they actually knew it would not be possible to deliver in July.

My points are: they notified us to pay the final payment for the assembly and shipment in May 22 and would deliver the product no later than the end of July. Thus, from May 22 to the end of July, the process prior to the assembly and shipment had been fine.
But, their July 28 announcement said the tapeout was failed. That is, their May 22's announcement is a deceptive marketing strategy aiming to collect our final payment.

Also, your attack is right. Our contract does not authorize the seller to change the delivery date after their notice of collecting final payment.

I am just following the instruction to mail a mediation letter to Alpha and waiting their response before Sept 1. I will file a claim online after receiving their response.

I just mailed a mediation letter to the address of Alpha Tech from a friend address in Lancaster. In the letter, I asked AT to reply
within two weeks, up to Sept 1st. Your site provides more information of Small Claim in UK that what I had learnt before I sent the letter.
